General terms and conditions

Terms and conditions for Kylslaget AB's products and services.

1. Application

These general terms and conditions apply to Kylslaget AB's sale of products and services (“Products” and “Services”) to consumers and businesses, unless otherwise agreed in writing between Kylslaget AB (“Kylslaget”) and the customer (the “Customer”).
For sales to consumers, mandatory legislation applies, including the Swedish Consumer Sales Act (1990:932), the Swedish Consumer Services Act (1985:716) and the Swedish Distance and Off-Premises Contracts Act (2005:59).

2. Products and services

Products sold by Kylslaget are intended for use in Sweden. Where required, Swedish-language instructions are provided in physical or digital form. Kylslaget also performs installation, service and related work.

3. Orders and agreements

Orders can be placed with Kylslaget by telephone or email. An agreement is concluded when Kylslaget has confirmed the order in writing through an order or booking confirmation by email and/or SMS.
Kylslaget does not enter into agreements with minors without the consent of a guardian. Images and illustrations in Kylslaget's materials are for guidance and may differ from the actual product. Kylslaget may correct errors concerning stock status or similar matters. If a product has been discontinued or cannot be obtained despite reasonable efforts, Kylslaget is not required to deliver it.

4. Orders through customer service (telephone/email)

For orders placed through customer service, the Customer is registered and receives confirmation by email and/or SMS. Any advance payment or payment link is communicated with the confirmation. The agreement is considered concluded in accordance with section 3.

5. Prices and payment terms

Prices are stated in Swedish kronor, including VAT unless otherwise indicated.
All payments are made against invoice. Standard terms are net 10 days. By separate agreement, the payment period may be extended to 30, 60 or 90 days and may be subject to a credit check.

The invoice is issued after the work or installation has been completed, unless otherwise agreed.
In the event of late payment, default interest is charged from the due date in accordance with the Swedish Interest Act.

6. Delivery and delivery times

Products: The normal delivery time is 2–5 working days. Delivery may be made to the Customer's address or, for a purchase with installation, directly to the installer, who brings the product on installation day. If delivery to the installer is selected, the withdrawal period begins when the installer receives the product.
Services (installation/service): The normal booking interval is 2–4 weeks and may vary by season.

The Customer's responsibility during installation: The installation area must be clear and accessible. For replacements, existing pipes must be accessible and visible. The road to the address must be passable. An island surcharge may apply to islands without a fixed bridge connection, or where car ferries run infrequently.

Transport damage: The Customer must inspect the delivery carefully on receipt. Any transport damage must be reported to Kylslaget within ten (10) days of receipt.

7. Product availability before installation

If the Customer has selected home delivery, the Customer is responsible for ensuring that the product is on site for installation. If the product has not arrived one (1) week before the installation date, Kylslaget must be contacted to reschedule.

8. Unsuccessful visit

A fee of SEK 2,500 including VAT may be charged for an unsuccessful visit in the following cases:

  • The product is not on site at the agreed installation time when home delivery was selected.
  • The installation cannot be carried out under the conditions on site, for example a concrete wall without a prepared opening where this was required.
  • The ordered product does not fit in the intended location and an alternative placement cannot be accepted.
  • The person who placed the order cancels or reschedules the service less than 48 hours before the agreed time. For bookings that fall on or immediately adjacent to a public holiday, cancellation or rescheduling must take place no later than 48 hours before the agreed time or on the last working day before the public holiday, whichever occurs first.
  • The road to the address is not passable.
  • The electrical distribution board is unearthed or in a condition that prevents installation in accordance with applicable electrical-safety requirements. In such cases, an authorised electrician must be engaged to rebuild or remedy the distribution board before installation can be completed.

Kylslaget can assist in arranging core drilling and/or an electrician if requested when the order is placed.

9. Right of withdrawal (consumers)

The Customer has a 14-day right of withdrawal under the Swedish Distance Contracts Act. The period runs from the day the Product is received or, for delivery to an installer, from the day the installer receives the Product. The Product must be in substantially unchanged condition. Consumables such as filters and cleaning agents must remain unopened.
The Customer pays the return shipping and should return the Product in its original packaging where possible. Kylslaget makes the refund within 10 banking days after receiving and approving the return.
The right of withdrawal does not apply to made-to-order or customised products. Heat pumps in categories normally ordered specifically for the Customer's project may be classified as made-to-order products. A used product may be returned, but a deduction for diminished value may be applied in accordance with applicable rules.

10. ROT tax deduction

If the Customer intends to use the ROT tax deduction under the Swedish Income Tax Act, the invoice model applies. The Customer must provide the personal identity number of the person or persons claiming the deduction, as well as the property designation or the housing cooperative's registration number and the apartment number. Kylslaget itemises the labour cost on the invoice.
If the Swedish Tax Agency wholly or partially refuses payment, Kylslaget is entitled to invoice the corresponding amount to the Customer for payment within 10 days. Default interest accrues from the date of Kylslaget's request to the Swedish Tax Agency. For a tenant-owned apartment, ROT is normally approved for work inside the apartment.

11. Warranty and complaints

Warranty terms follow the relevant manufacturer's warranty unless otherwise stated. As a general rule, purchases without installation carry a one-year materials warranty unless otherwise indicated. Accessories generally carry a two-year materials warranty. Consumers have the right to make a complaint under mandatory law.
Extended or special warranties may require service at specified intervals by technicians approved by Kylslaget.
If a reported fault cannot be reproduced during an on-site visit, the troubleshooting is not covered by warranty. The Customer is responsible for additional costs required for a safe working environment, such as scaffolding or a mobile elevating work platform, including during warranty work.

Troubleshooting: The Customer may be invoiced for a fault report that requires troubleshooting. The invoice is credited if the fault is covered by warranty.

Limitation for business customers: For a Customer who is not a consumer, Kylslaget's liability for damages caused by a defective product or delay is limited to 50% of the purchase price paid for the relevant delivery. Warranty and complaint rights for businesses apply only where, and to the extent that, they are expressly stated.

12. Complaints and service matters

Complaints, service matters and warranty matters should primarily be reported to Kylslaget's customer service. Manufacturing defects must be confirmed by a service technician or workshop approved by Kylslaget before any remedy or replacement is decided. For an approved complaint, Kylslaget reimburses reasonable shipping costs.

14. Cookies, analytics and tag management

Kylslaget may use cookies for necessary functionality, performance, functionality, marketing and social media. Cookie settings can be managed in the browser; some functions may be affected if cookies are blocked.
Kylslaget may use Google Analytics and/or Google Tag Manager for statistics and tag management. Google Tag Manager does not itself store personal data and is used to distribute scripts. Processing through third-party services takes place in accordance with the respective provider's privacy policy.

15. Uncollected order

If a shipment is not collected, the Customer is charged the shipping cost and an administrative fee of SEK 390.

16. Liability for impediments to delivery

Kylslaget is not liable for impediments beyond Kylslaget's control (force majeure), such as extreme weather, government decisions, strikes, transport disruptions or equivalent events.

17. Disputes and governing law

Swedish law applies. In disputes with consumers, Kylslaget follows the recommendations of the Swedish National Board for Consumer Disputes (ARN). Disputes with business customers will be heard by Stockholm District Court as the court of first instance.
